DEFECTS
The Customer shall inspect the Goods upon delivery and must notify the Supplier of any defect, shortage in quantity, damage, or failure to comply with the description or quotation, verbally within twenty-four (24) hours and in writing within seven (7) days of delivery. If the Customer believes the Goods are defective in any way, the Customer shall give the Supplier a reasonable opportunity to inspect the Goods within a reasonable time after delivery. If the Customer fails to comply with these provisions, the Goods shall be presumed to be free from any defect or damage. For defective Goods that the Supplier has agreed in writing the Customer is entitled to reject, the Supplier’s liability is limited, at the Supplier’s discretion, to replacing or repairing the Goods.
RETURNS
Returns will only be accepted provided that:
(a) The Customer has complied with the provisions of clause 8.1 [likely should reference clause 9.1 — see note below]; and
(b) The Supplier has agreed in writing to accept the return of the Goods; and
(c) The Goods are returned at the Customer’s cost within twenty-four (24) hours of the delivery date; and
(d) The Supplier will not be liable for Goods that have not been stored or used properly or in accordance with any directions; and
(e) The Goods are returned in the condition in which they were delivered, together with all packaging materials, brochures, and instruction materials, in as-new condition as far as is reasonably possible in the circumstances.
The Supplier may, in its discretion, accept the return of Goods for credit, but any such return may be subject to handling fees equal to the charge incurred by the Supplier, together with any freight costs.
Together, they set a strict window: notify defects within 24 hours (verbal) / 7 days (written), and if a return is agreed, physically return the goods within 24 hours of delivery, at the customer’s cost, in as-new condition. Failure to meet the notification deadline creates a presumption the goods were fine on delivery, and even an approved return only yields credit — not a refund — potentially minus handling and freight fees.
